Terms of Service (Important Legal Information)

• - All merchandise purchased through Zaphon Prom, is guaranteed to be free of manufacturers defects, unless otherwise stated, (i.e., irregulars, defectives, etc.).
• - Please Note: All items will be processed, and the charge placed to the account on file upon submission. Please check "Availability" information in the item description for estimated time of arrival.
• - Absolutely no returns will be accepted without prior written authorization from Management. No returns or exchanges will be allowed for any item viewed as worn, showing dirt, original tags removed or removed from the original packaging as well as items reduced/on clearance or 'On Sale'. Contact a Customer Care associate via our Contact Form to make a return request.

Shipments sent back to Zaphon Prom for any reason other than a packing error or proven defective goods, will be subject to a 35% restocking fee, less return shipping and processing fees incurred/lost by Paypal or Credit Card Merchant and the balance held for store merchandise credit ONLY. All claims must be made and received within 3 days of receipt of merchandise. In the event that the item is not available to replace, a store credit will be issued, good for up to one (1) year from date of purchase.
Once your order is placed, you cannot change, alter, or cancel your order in any way. In the event an item in your order is not available you will be offered alternatives or the option to receive a full refund for the item. No guarantees on delivery date and/or time.

Zaphon Prom will deliver the Product or Products to You: at the address for delivery ("Delivery Address") provided by you in the Customer Details Form in the Offer; by way of the Shipping Method selected by you in the Offer; at the price ("Shipping Price") that corresponds with the Shipping Method selected by You in the Offer; and within a time that is, at the discretion of Zaphon Prom, feasible. Anyone at the Delivery Address who receives the Product or Products is deemed to be authorized to receive the Product or Products. Property and risk in the Product or Products passes to you upon delivery to the Delivery Address. Please be aware, due to the special nature and speed of our service, we cannot cancel orders. Once the order is placed, all sales are FINAL. No returns accepted without authorization. Cancellations, refused deliveries, undeliverable shipments, unclaimed parcels and/or unauthorized returns subject to 35% restocking fee in addition to applicable shipping fees, insurance fees, and any losses incurred by us. Original shipping fees are non-refundable. No credit card refunds, store credit only.

If for any reason you are not completely satisfied with your purchase you may return your merchandise for STORE CREDIT LESS SHIPPING FEES AND RESTOCKING FEES. NO RETURNS ARE ACCEPTED FOR ANY CUSTOM MADE OR FINAL SALE MERCHANDISE.

* We have no control and accept no responsibility for the sizing you select for your merchandise. Please check the provided size chart to ensure correct sizing.
Please note:There are no returns, exchanges or cancellations on custom made, final sales, or sale merchandise. Intimate apparel, lingerie, cosmetics, and/or swimsuits will not be accepted for return.

RETURN AND EXCHANGE POLICY

HOW TO RETURN AN ITEM:
If for any reason you are not completely satisfied with your purchase you may return your merchandise for STORE CREDIT LESS SHIPPING FEES AND APPROPRIATE RESTOCKING FEES. Store credit may be used for any future purchases on our website for merchandise of any kind but store credit cannot be used towards shipping costs. We sell seasonal, time sensitive items so you must contact us within 3 days of receiving your order for a return authorization number. Merchandise must be postmarked within 3 days of receiving a return authorization number from us. Merchandise returned without authorization or returned late will be refused. All original tags must be in place to receive credit for the return. All merchandise is carefully inspected before accepted by our return department. Any items returned to us without original tags in place, that appear to have been worn, or are not sent back in the condition it was sent will not receive credit in any form. Customer is responsible for return shipping fees via their carrier of choice, provided they receive a valid tracking number for proof of return.

HOW TO EXCHANGE AN ITEM:
If you need to exchange an item for any reason you must return the original item to us per our return policy above. Once the returned item is received it will be inspected and you will be issued the appropriate store credit in accordance with our return policy. Once you receive your store credit code you will need to place a new order. At checkout, enter the store credit code and press the Use Gift Certificate button to apply the credit. If you are concerned about your event date being too close for an exchanged item, please contact our Customer Care department for assistance in expediting your return.

NON-RETURNABLE / NON-REFUNDABLE ITEMS:
Sale items, Final Sale/No Return items, intimate apparel, lingerie, cosmetics, and swimsuits cannot be returned, exchanged or cancelled.

PLEASE NOTE:Any returns or exchanges postmarked after 3 days of your receipt date and/or missing a return authorization number will be returned to you at your shipping expense. The goods must be returned in original condition. We have 100% inspection on merchandise leaving the warehouse to ensure our merchandise is sent free of defects. All returns are inspected upon receipt. Items must not have been worn, washed, altered and must have all originals tags attached and in original packaging. Items with snags, rips, make-up stains, odors (i.e. cigarette smoke) or other damages will result in the item being returned to you. If you do not accept the item being returned to you, you will not receive credit of any kind.

RESTOCKING FEES:
A 15% restocking fee applies for all returns and/or exchanges, except for errors and defects.

STORE CREDIT:
Store credit is valid for one year after issue date.

RETURN AUTHORIZATION REQUEST:

To request a return authorization number, please visit Customer Care and fill out the Contact Form. Make sure you have added ZaphonProm.com to your email address book to insure you receive our email with your return authorization number. Please be sure to put the RA # issued for your return on the outside of the box, as follows: "RA #: number issued."

International Shipping Policies: YYou may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Custom and import duties are not included in our shipping charges. Customs policies vary widely from country to country; you should contact your local customs office for further information before you place your order. Additionally, when ordering from ZaphonProm.com you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

ZaphonProm.com reserves the right to approve which countries it will ship to and in the event a country is not approved, the buyer will receive a full refund.

On international shipments, delays may occur that are beyond our control caused by such factors as weather, language barriers, duties, taxes, import restrictions and custom services.

If duties are not paid by on entry to destination country, or the merchandise is refused, the product will be abandoned in the destination country and the customer will be responsible for 100% of the product cost and shipping. The customer will not receive any type of refund or credit for abandoned products.

ORDER CHANGES AND CANCELLATIONS
Once your order is placed, you cannot change, alter, or cancel your order in any way. In the event an item in your order is not available you will be offered alternatives and the option to receive a full refund.

PRODUCT AVAILABILITY
Please check product availability time on the product page. To determine the estimated time of arrival for your product, add your selected method of shipping time to the availability time. No guarantees on delivery date and/or time.
ZaphonProm.com has made every effort to display accurately the products featured on the Site. However, the colors we use and the capabilities of your computer monitor will affect the colors you see on your screen. Zaphon Prom cannot guarantee that your monitors display of any color, texture, or merchandise details will be accurate.

Zaphon Prom is not responsible for errors made in selecting a dress size and cannot guarantee a dress will fit. It is the sole responsibility of the shopper to use a tape measure to take her measurements properly and then select the size that best fits her based on the size chart for the particular item purchased. Zaphon Prom reserves the right to change sizes available and the size charts at any time.

SITE CHANGES
In order to keep the site current with our latest fashion ideas, Zaphon Prom frequently changes the merchandise offered. This means that we cannot guarantee that an item displayed on a previous visit to the Site will still be available when you visit again. We reserve the right to make changes to the Site without prior notice. Should you be unable to locate an item you saw on a previous visit, please contact us and we will make every effort to meet your needs. Prices displayed on the Site are quoted in U.S. dollars and are valid and effective only in the United States.

Risk of Loss: Risk of loss or transfer of title to the Buyer or customer occurs when Zaphon Prom delivers the merchandise ordered to a common carrier in good condition for shipment to the customer.
User Comments, Feedback, Postcards, and other submissions: We welcome your comments and feedback regarding the Site, our products and our services. All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Zaphon Prom on or by the Site or otherwise disclosed, submitted or offered in connection with your use of the Site (collectively, the "Comments") shall be and remain Zaphon Prom's property.

Such disclosure, submission or offer of any Comments shall constitute an assignment to Zaphon Prom of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments without payment of any compensation.
